HOOKED — TERMS OF USE AND RELEASE OF LIABILITY

Welcome to HOOKED, operated by STIX Outdoors LLC ("Company," "we," "us," "our"). These Terms of Use ("Terms") govern your access to and use of the HOOKED mobile application and related services (the "App"). By downloading, accessing, or using the App, you ("User," "you") agree to be bound by these Terms. If you do not agree, do not use the App. 1. Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. If you are under 18, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. 2. Account Registration. You may need to create an account to use certain features. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account. We may suspend or terminate accounts that violate these Terms. 3. License to Use the App. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial recreational purposes, subject to these Terms. You may not copy, modify, reverse-engineer, distribute, or create derivative works from the App. 4. User Content. You retain ownership of content you submit (catch logs, photos, tournament entries, comments—"User Content"). By submitting User Content, you grant STIX Outdoors LLC a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute it in connection with operating and promoting the App and its services. You represent that you own or have the rights to any content you submit and that it does not violate any law or third-party right. 5. Acceptable Use. You agree not to: submit false catch or tournament data; harass or harm other users; upload unlawful, infringing, or harmful content; interfere with the App's operation or security; scrape or harvest data; or use the App for any unlawful purpose. We reserve the right to disqualify entries, remove content, and terminate accounts for violations. 6. Tournaments and Competitive Features. Tournaments, leaderboards, and scoring are subject to their own rules published within the App. We reserve the right to verify entries, resolve disputes, disqualify participants for rule violations, and modify or cancel any competition at our discretion. All tournament decisions by STIX Outdoors LLC are final. 7. Assumption of Risk. You understand that fishing, kayaking, boating, and related outdoor activities involve inherent and significant risks, including but not limited to drowning, capsizing, adverse weather, equipment failure, collision, injury from hooks or gear, wildlife encounters, and death. You voluntarily assume all such risks, whether known or unknown, arising from your use of the App or your participation in any activity organized, promoted, tracked, or facilitated through it. 8. Nature of the App; No Reliance. The App provides information, tracking, tournament features, location data, and content for informational and recreational purposes only. We do not guarantee the accuracy, completeness, safety, or reliability of any information, including navigation data, weather, catch records, tournament results, or location markers. You are solely responsible for your own safety and decisions and should not rely on the App for navigation or safety-critical purposes. 9. Release and Waiver of Liability. To the fullest extent permitted by law, you release, waive, and discharge STIX Outdoors LLC, its members, officers, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising out of or related to your use of the App or participation in any activity connected to it, whether caused by negligence or otherwise. 10. Indemnification. You agree to indemnify and hold harmless STIX Outdoors LLC and its members, officers, employees, agents, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) brought by you or any third party arising from your use of the App, your User Content, or your violation of these Terms. 11. No Warranty. The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. 12. Limitation of Liability. To the fullest extent permitted by law, STIX Outdoors LLC's total liability for any claim arising from the App shall not exceed the greater of the amount you paid us to use the App in the twelve months preceding the claim, or one hundred dollars ($100). We shall not be liable for any indirect, incidental, consequential, or punitive damages. 13. Third-Party Services. The App may integrate with or link to third-party services (maps, weather, payment processors). We are not responsible for the content, accuracy, or practices of third-party services, which are governed by their own terms. 14. Modifications to the Terms and App. We may update these Terms at any time. Material changes will be communicated through the App or by notice, and continued use after changes take effect constitutes acceptance. We may modify, suspend, or discontinue any part of the App at any time. 15. Termination. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination—including the Release, Indemnification, and Limitation of Liability—will survive. 16. Governing Law and Dispute Resolution. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App shall be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. 17. Severability. If any provision is held unenforceable, the remaining provisions remain in full effect. 18. Entire Agreement. These Terms constitute the entire agreement between you and STIX Outdoors LLC regarding the App and supersede any prior agreements. By tapping "I Agree" or by accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and Release of Liability.
